**UPDATE**- CIPO FEE INCREASE TO TAKE EFFECT JANUARY 1, 2024

In an update to our blog post of January 5, 2023, official regulations containing the adjusted fees proposed by the Canadian Intellectual Property Office (CIPO) have now been published in the Canada Gazette, Part II, without any substantive changes. This means that many patent, trademark, copyright and industrial design fees will increase by an average of 25%, effective January 1, 2024.

Holders of Canadian patents and trademarks are encouraged to review their filing strategies and renewal/maintenance portfolios to determine whether cost savings may be realized by filing and/or paying renewal/maintenance fees early, in advance of January 1, 2024.  Patent applicants who are considering filing in Canada may wish to enter national phase (or file a Convention application) and/or request examination, prior to the fee increase.

Note that under the provisions of the Trademarks Act, a trademark registration may be renewed up to six months prior to the expiration of the current term. Holders of trademark registrations coming due for renewal in 2024, particularly those with registrations covering multiple classes of goods and services, are encouraged to take early action to classify the goods/services covered by their registrations and to attend to payment of the base renewal fee and any applicable additional class fees in advance of January 1, 2024.
